Sued over Cambridge Analytica, Facebook to turn over emails

Mr. Zuckerberg and Mr. Zuckerberg’s Technological Advisors Representing Facebook and Facebook’s Parent, Mr. Mark Zuckerberg and Facebook Inc., will be added as defendants in the lawsuit. One additional defendant will be a class member named John Doe Number 78. Plaintiff’s motion in March, detailing his and the plaintiff’s discovery obligations of, among other things, the discovery of any and all prior and ongoing records and all communications with lawyers, was denied. The Facebook and Mr. Zuckerberg defendants now intend to appeal that decision.

“We had planned to respond to the plaintiffs motion this morning, but we are filing an addendum to address all of the issues the judge raised about our right to disclose communications we have already reviewed,” said a Facebook spokesman. “Any communication we have with our counsel regarding matters that are currently involved in litigation will not be subject to the requirement for disclosure. This includes communications that occurred before the filing of our discovery motion.”

“The plaintiff only filed his motion last week, and after nearly two months of looking for information, we found a third party potentially hidden in the face of a discovery order from the trial court,” said Benjamin Rudolph, one of the plaintiff’s attorneys. “He filed a motion to extend the deadline yesterday without giving us notice. We argued that information we got would be confidential, but they countered that we were attacking their rights to protect their right to keep secret all information that we found.”
